
Article 38(3)(b) of the Constitution of Kenya 2010
The right to political choices is a Constitutionally guaranteed right provided for in Article 38(3)(b) of the Constitution of Kenya 2010. Like any other democratic nation, political parties play an integral role in political selection.
They nominate candidates who participate in elections and define the set of politicians from which voters can choose through conduct of party primaries.
To ensure optimal representation of Special Interest Groups, political parties in Kenya not only need to establish legislations that ensure inclusion but also promote internal mechanisms that ensure a level playing field for SIGs’ political participation line with existing laws, international conventions and agreements.
