
ELGIA in partnership with JCE, undertake the development of a comprehensive Case Digest
Advancing jurisprudence on Electoral Dispute Resolution (EDR) frameworks is a core component of ELGIA’s technical support for electoral reforms. In collaboration with the Judiciary Committee on Elections (JCE), ELGIA has undertaken the development of a comprehensive Case Digest. This document provides a legal analysis of the High Court's decisions in its mandate to adjudicate pre-election and post-election disputes arising from Kenya's 2022 general elections.
The review of these judicial rulings plays a crucial role in evaluating the effectiveness of the EDR process during the 2022 elections and offers valuable insights for future legal reforms. The Case Digest carefully documents and examines the jurisprudence established by the High Court, Court of Appeal, and Supreme Court on election-related disputes. The cases included have been selected for their significance in shaping election law jurisprudence.
To finalize and validate this important legal resource, ELGIA is convening a validation workshop at Villa Rosa Kempinski Hotel in Nairobi. This workshop will provide an opportunity for stakeholders to review, refine, and endorse the Case Digest, ensuring its relevance and utility for future electoral reforms.
